Amends the Local Coastal Program to allow “farm stays” on properties in the Agriculture Exclusive zoning district.
Restricts camping on public property.
Adopts the 2019 California Building Standards Code
Establishes interim restrictions on the use of the Point Arena Pier and adjacent parking lot area to prohibit loitering and the parking of vehicles except for a valid business purpose, as well as sport fishing and drive-in films.
Requires the wearing of facial coverings in specified public settings as per the Governor’s Executive Order N-25-20 and the County of Mendocino Public Health Orders and provides appropriate administrative and criminal mechanisms for the willful or negligent failure to do so.
Adds Section 5.30 to Chapter V of the Point Arena Municipal Code to provide requirements and standards for residential visitor serving short-term rentals of less than 30 days. These standards are intended to provide accountability and ensure that short term rentals are compatible with and do not adversely impact neighboring uses or housing availability.

Amends Point Arena Municipal Code by adding Appendix “B”- Streets, Roads & Driveway Standards to Chapter 17-Subdivisions. This appendix updates and clarifies Appendix “A” provides definitions, as well as design and construction standards for all street, roads and driveways. It applies to both private and public streets and sidewalks located within the City of Point Arena. It sets detailed standards for public-right-of-way curb cuts, street alignments, street grades, and intersections. It requires all submittals of road-way related improvement plans, parcel and final maps to be signed by an engineer. It includes procedures for soil and material testing. It designates the City of Ft. Bragg Street Standard Plans detail drawings Series 200 to be utilized for plan details submitted to the City.
The Ordinance amends Chapter 5.20.090 (10) of the City of Point Arena’s Municipal Code to change the permissible hours of operation for cannabis retailers from the current 9am to 7pm seven days a week to 9am to 10pm seven days a week. Chapter 5.20.090 (10) will read as follows:
10) Cannabis retailer hours of operation shall be limited to the hours of 9:00 a.m. to 10:00 p.m. and may operate seven (7) days a week.
The Ordinance amends Chapter 5.20 of the Point Arena Municipal Code, which was limited to the regulation of medical cannabis, to include regulation of commercial cannabis activity related to both medical and adult use. It expresses the City’s intent to locally regulate certain commercial cannabis activities, in compliance with State law, to promote the health, safety and general welfare of the residents and businesses of the City of Point Arena pursuant to its constitutional police powers.
The Ordinance revises many provisions, but keeps basic local licensing requirements provisions in place, regarding the Cultivation, Sale, Manufacturing, Testing and Distribution of cannabis for adult use with the City’s limits. It lists the categories of State licenses the City intends to authorize locally, adds administrative enforcement remedies, and includes new licensing requirements to conform with Proposition 64, and recent amendments thereto.
This ordinance updates the current Floodplain Management Ordinance to adopt higher standards to be applied under the Community Rating Standard which will result in reduced premiums for all flood insurance policy holders within the community.
Establishes a system of administrative citations and hearings to ensure prompt and responsive compliance with the Point Arena Municipal Code and state law. It enhances the City’s ability to recover its costs and maintain the integrity of the code enforcement system. It also improves the City’s ability to impose and collect penalties from violators and provides due process and appeal rights regarding violations.
Establishes that Sonoma Clean Power can compete with PG&E to provide electricity in the City of Point Arena.
Establishes a tax on medical cannabis of 3% and recreational cannabis of 7%. Approved by voters on November 8, 2016.
Raises the Transit Occupancy Tax from 10% to 12%. Approved by voters on November 8, 2016.
Regulates the cultivation, processing, testing, delivery, and dispensing of medical marijuana in the City of Point Arena.
